General Informations
These terms and conditions apply to purchases from The Polish Home Gallery Online Shop.
The Online Shop that functions on www.galeriadp.com is being held by The Marco Der Pole Company, M. Frysztacki & R. Kawęski with place of business in Krakow, Legionów Piłsudskiego St. 23/8. NIP (Number of Tax Identification) 677-16-98-059, REGON (National Economy Registration Number) 351165232. Operated by The Polish Home Gallery, Mariacki Sq. 3, 31-042 Krakow. We also sell goods in the stationary store.
Offer
All goods are made by Polish artists in Poland. Each item is a unique specimen, made by hand, by the artists and therefore next works may slightly differ from those, that are shown at The Shop.
Prices
All Prices presented at The Shop include VAT (gross) and are given in ‘zloty’ (PLN) or euro (€). Prices given do not include delivery expenses and may be changed without notification. Prices in euro are being set by the current exchange rate of NBP (National Bank of Poland).
Time of Realization
The time of realization for standard orders is 2-5 working days from the date of acceptation of order until sending ordered goods to the Customer. Exceptions are those goods that are “made to order”. In that case the customer service will notify the Customer about the predicted time of realization. Should the realization of the Order or part of the Order prove impossible, the Customer will be notified shortly by e-mail or by telephone. In that case the Customer will make a decision about extension of the time of realization or canceling the Order.
The Customer is entitled to change or cancel the Order only until the moment when the Invoice of that Order is issued. The Order that had been sent could not be canceled.
In case of incomplete Details of the Customer, the Order will not be realized. We ask for the telephone number in case of any problems that may occur, to solve them as quick as possible. Details like: Name, Surname, Address, e-mail, Tel. Number are essential for sending the Order.
Delivery Costs
Polish Post on the territory of Poland - package up to 1kg – 10PLN (14PLN - when it’s paid on delivery).
UPS Courier Service on the territory of Poland – up to 1kg – 15PLN (when paid on delivery – it’s 6PLN extra).
Costs of sending the package abroad is calculated individually by the personnel of the Shop.
If the package is not collected by the Customer, all the costs of sending and returning of the package will be covered by the Customer.
The Shop is not liable for any delay in making deliveries.
Payment
You may pay for the Order:
on delivery
by money transfer (prepayment)
with credit or debit card

The Invoice would be written out according to details at the Registration Form or after sending the details by mail or fax. The details should include the authorization of the Purchaser for writing out the Invoice without the signature of the Recipient.
Abroad/overseas packages can only be paid by the credit or debit card or with money transfer. The Shop of Polish Home Gallery do not send abroad/overseas packages paid on delivery.
Returns
The Customer can cancel the Purchase within 10 days from the date of receiving the Order by sending an written statement to: Polish Home Gallery, Plac Mariacki 3, 31-042 Krakow, Poland. Cancellation of the Purchase is only possible when the Product is not unpacked (intact packaging), is not used, and is not damaged. After the cancellation the Product ordered should be immediately sent on the address given above.
The Shop is obliged to refund the amount of money is equal to the price of the Product reduced by money transfer costs in case of bank transfer or credit card commission in case of credit card payment. The refund will be made right after receiving the Return. The costs of delivery and return have to be covered by the Customer. In case of sending back the Package at the expense of the Shop, the amount of money that was due to be paid back, will also be reduced by the costs incurred to the Shop by return delivery. We return money by money transfer to the account given. In some cases the return of money could be done by postal order. In that case the amount returned will be reduced of the cost of postal order.
Complaints
If the packaging is damaged or looks like was opened the Customer has a right to not accept the package and draw up in presence of Courier or at the Post Office the Loss Certificate. Goods that are faulty or are already damaged shall be replaced with new ones only on condition that a notification of damage is sent within 5 working days from the date of receiving the Package on the address: : Polish Home Gallery, Plac Mariacki 3, 31-042 Krakow, Poland.
The Shop will consider the Complaint within 14 days. In case of unfounded claim or damaging the Product by the Customer, all costs are covered by the Customer. The Shop do not accept packages sent back on the address given above to be paid on delivery /by the Shop/.
Privacy
The Polish Home Gallery is not liable for shopping made by third parties using the account or password of the Customer. The Customer is obliged to keep his login and password to himself.
The Polish Home Gallery reserves the right to change the Regulations partially or as a whole.
All personal details provided by the Customer shall be used only for purpose of Order realization and only by the Shop. They will never be made available by the Shop to any third party. Customer agrees that their details are processed for the purpose of Order realization.
Final arrangements
Any disagreements that may result form the realization of the transactions at the Shop www.galeriadp.com shall be resolved by the agreement of the parties by means of adjudication first. Shall this not bring mutually acceptable compromise, the disagreement shall be taken to the Court in Krakow, Poland.
The Pictures placed in the Offer of the Shop as well as some dimensions of goods may differ from the real appearance of the goods available on sale. Mainly it concerns the cracks, distribution of glaze, saturation and shade of color.
The majority of pictures on www.galeriadp.com are the property of the Shop. Copying or placing the pictures at other websites is strictly forbidden. Pictures can be accessible only by agreement of the Shop.
Placing the Order is equal with the agreement for all the Terms & Conditions.
